When are Quartzsite's citizens entitled to the truth?

  • When WES HUNTLEY refused to recuse himself from a meeting on backflow devices Tuesday, April 13, 2010, it was a violation of the law.

    It is illegal for councilmen who have a CONFLICT OF INTEREST to participate in any proceedings that will allow them inside information or bring about circumstances in which they or their companies, their friends, their relatives or other associates could conceivably profit or obtain other information via the 'use' individual's  of their publicly held position.

    This matter has yet to be considered publicly -- and it is a pending Expose. Huntley and the Town Attorney Pamela Walsma of SHADLE & WALSMA Law Offices in Yuma, Arizona were properly apprised of this conflict of interest     before Huntley participated in this meeting and did nothing to prevent it. Huntley went ahead with the EXECUTIVE SESSION MEETING which took place behind closed doors and, during the session, several council meeting attendees waiting in the Town Hall portion of the building criticized his decision to go through with his participation and indicated that they were aware that his participation constituted a violation of the law and a violation of ethics.

    Editor's Note: Quartzsite's officials should understand that just because the people of Quartzsite stood silent did not indicate they do not understand ethics violations nor would ignore clear evidence of law-breaking.

    What possible reason could they have had for meeting secretly with Huntley present in spite of proper notification?
  • When CORPLAN wanted to consider Quartzsite as a possible site for a prison, a secret meeting was held.

    It is illegal for councilmen to meet privately with more than four of them present to discuss any matters away from the public eye.
    This event was in clear violation of the Sunshine Law.
    This matter has yet to be considered publicly -- and it is a pending Expose. The secret meetings in Quartzsite are in clear violation of the SUNSHINE ACT and must no longer be tolerated. If our elected officials are put in office to represent the people, they need to stop hiding from their constituents and make their decisions in public for all to see as required by LAW.

    What are they attempting to hide by holding secret meetings? What possible reason could they have for meeting secretly with representatives of a company widely publicized to be involved in less-than-ethical deals?

 

  • GOLDWATER has taken on GLENDALE over FOIA requests

    Like Quartzsite, Glendale decided to ignore FOIA requests -- even though they were coming from the Goldwater Institute

    It didn't have to come to this -- but, as the Goldwater Institute attorney pointed out, $20 million dollars in taxpayer money could be at stake. This is what responsible communities do. They ask questions, they review documents, they get answers. The law is for the good of the people not the convenience of the sitting officials.

    Like Quartzsite, the cases the city provided as the basis for their denials were not sufficient.

 Quartzsite is also accused of refusing to provide FOIA documents...

  • There are laws designed to protect taxpayers. When documents are not provided as required under the law, the law is not the problem.

Quartzsite official 'acting Mayor' Wes Huntley needs to recuse himself from the 'Executive Session' meeting that is scheduled for Tuesday evening...

  • The Executive Session scheduled for Tuesday evening concerning backflow devices should require 'acting Mayor' Wes Huntley to recuse himself. If that doesn't happen, a challenge is sure to occur.

    It is illegal for councilmen with clear conflicts of interest to participate in meetings -- before the public or out of the public eye -- and Huntley's position as a Backflow Device Certifier puts him in clear conflict

    With Huntley out of the room, the purpose of this 'executive session' meeting is clearly in question. Whose idea was an executive session meeting over backflow devices? What was the topic intended to be?

Quartzsite is under fire over water and sewer rates - How high can rates go?

  • The water and sewer rate issue is anything but dead.

    The truth has not begun to be told of the impact the water and sewer rate increases will have on the taxpayers as well as the community itself. By withholding this information from the public, people have been denied their right to make decisions on their property values. If, for instance, you can't afford the new rates and choose to sell your home or your showground, your RV park or your mobile home park based upon those new rates, you are now at a sizable disadvantage. Potential buyers are highly likely to choose an area that is not financially devastated and a town council that's not likely to take out their lack of foresight on new people -- and new businesses -- coming into the area. Had you known what was hidden from view -- that there were massive increases in store -- you might have had a chance to act and, therefore, protect yourself financially from the fallout.　 You may even have chosen to decrease your financial exposure by selling before property values plummeted, leaving many with significant losses they could not afford to suffer. These areas depict a few in which citizens need to be able to trust their officials, and suffer greatly when that trust is misguided.

    Most citizens are respectful of their nation's laws and try to live within them. When officials engage in any level of corruption that damage their citizenry, it's particularly devastating. They can find their voices stifled and the sympathies of a jury against them. Often, they allow officials greater leeway and subsequently allow greater losses than they would if they were dealing with private entities, so the public position of officials can become a issue in terms of public trust. Where is the line?

 

Withholding of the Public Records and Destruction of Public Records

  • The law protects categories of documents and records of public meetings are included.

    It is illegal for for these records to be removed without first transcribing the tapes into document form.

    E-mails of any management person is categorized as a permanent record and must be transcribed before destruction -- and there are problems with the handling of these documents. To wipe out the document without proper categorization of the data therein, is a crime.

    The video camera in the town council meeting room was said to be turned off during a meeting when individuals asked for copies of the video made by that camera.




 

Upcoming Events

  • Even though the Q Mountain Estates water deal has been temporarily tabled, it's still underway.

    What happened and why? Why should people throughout the community bear the burdensome plan for for the water and sewer project while Q Mountain Estates residents get a sweetheart deal? Should ANY of our community members have to pay a burdensome price for the lack of foresight of the officials in charge? Meetings are now being scheduled to discuss this issue.
